John Pilaccio faces an upgraded charge of first-degree murder in fatal stabbing of CVS employee Edeedson Cine Jr.

The Lindenhurst man accused of fatally stabbing a CVS worker on Christmas Day was indicted on an upgraded charge of first-degree murder, according to court records posted Wednesday.
John Pilaccio, 43, is charged with fatally stabbing Edeedson Cine Jr., 23, of West Babylon, as he was working behind the counter at the CVS in Lindenhurst at around 6:30 p.m. on Dec. 25. The first-degree murder charge says Pilaccio killed Cine while in the act of committing another crime, but there are no specifics.
Pilaccio was also indicted on two second-degree murder charges.
He pleaded not guilty to second-degree murder on Dec. 27 in Suffolk County First District Court. Judge John Kelly ordered him held without bail.
Pilaccio’s next court date is Jan. 7, where he's expected to be arraigned on the new charges.
His defense lawyer, Steve Fondulis, did not immediately respond to a call for comment.
Pilaccio allegedly fled the pharmacy after the deadly attack and police arrested him a short time later.
Suffolk County District Attorney Ray Tierney said Pilaccio implicated himself in the killing and the stabbing was recorded by store surveillance cameras.
"The first thing [Pilaccio] did when he got up to the cashier ... unfortunately was to attack him. The crime is captured on the video," Tierney said.
Cine was a deeply principled man who "had a way of showing up for people," his father, Edeedson Cine Sr., said at a recent vigil.
"We are grieving not only who he was, but also that he had yet to become," his father said.
